1. OUR TERMS AND CONDITIONS
1.1 Please read these terms and conditions carefully as they apply to your access and use of our website and the supply of travel information services by us to you through our website. You are responsible for bringing these terms to the attention of anyone else who may access the material on our website as a result of your introduction. Such persons will also be bound by these terms. These terms include important service information relating to our services and form the basis of any agreement between us should you wish to proceed with an order. We request that you pay particular attention to the privacy policy referred to in condition 16 below which sets out the principles with which we comply regarding the treatment of information about visitors to our website.
1.2 To protect your own interests, please read these terms and conditions carefully before agreeing to them. If you are uncertain as to your rights under them or you want an explanation about them please contact us on info@tripbod.com. If you do not agree with these terms and conditions, you are not authorised to use this website and no contractual agreement can be created between us.
1.3 You may save and download these terms and conditions for your future reference.
1.4 When you visit our website or send e-mails to us, you are communicating electronically. By agreeing to these terms and conditions you agree to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this website. You agree that all notices, agreements, disclosures and other communications that we provide to you electronically satisfy any requirement that such communications be in writing.
2. LEGAL NOTICE
2.1 All content of this website (including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software) is our exclusive property or that of our content suppliers and is, unless specifically stated otherwise, protected by copyright or similar intellectual property rights. It is published by us and may not be reproduced other than by downloading and viewing on a single computer and/or printing a single hard copy, for private purposes only. It is not to be otherwise reproduced, transmitted, made available on a network or used to create derivative works without our prior written consent. All our rights are formally reserved.
2.2 The trade marks, logos and service marks shown on our website, unless otherwise specified, are the trade marks of our Company. No rights are granted to use any of them without our prior written consent.
2.3 Any infringement of our rights will result in appropriate legal action.
2.4 Any framing of this website is prohibited. Please do not link directly to any other pages on this website. We do not accept any responsibility or liability for access to the material on any site which is connected by a link from this website.

3. DATA PROTECTION AND PRIVACY
Any information you give to us will be stored and used in accordance with our privacy policy set out in condition 18 below.
4. SECURITY
4.1 Access to your account, information and our services will be gained by using the username and the password selected by you during the registration procedure. You are responsible for ensuring the confidentiality and proper use of your username, password and account and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. In order to assist us with our security policy, you should not leave your computer terminal unattended while you are logged on to our website and you should ensure that it is switched off each time you have finished.
4.2 You must tell us immediately if you believe that an unauthorised person knows your username or password or has access to your account.
4.3 We reserve the right to refuse service or terminate accounts if we suspect that an unauthorised person is attempting to access it.
4.4 You agree that we shall not be liable for any losses you suffer as a result of unauthorised access to your account until such time as you have informed us of any unauthorised or possible unauthorised use of your username and password or of a breach of security. Our potential liability shall only then subsequently arise once we have had sufficient time to take all reasonably necessary steps to prevent any consequent breach of security or misuse of your confidential information.
5. HYPERLINKS
This website may include hyperlinks to sites operated by other parties but we are not responsible for examining or evaluating them and their inclusion does not imply our endorsement of their material. You therefore agree that we will not incur any liability in respect of the content of any site accessed through a hyperlink contained on this website.
6. BASIS OF AGREEMENT
6.1 We will treat each order for the supply of services as an offer by you to purchase the services in accordance with these terms and conditions.
6.2 You must be over 18 years of age to proceed with an order. If you are not then no contractually binding agreement can be established between us.
6.3 We will acknowledge receipt of your order immediately.
6.3.1 Once an order is submitted the details provided by the customer will be forwarded directly to the assigned local contact, or ‘Tripbod’, in the subscribed country. The Tripbod will confirm, within 72 hours, that details have been received and will then start to provide the information requested. The Tripbod will inform the traveller immediately if there is any problem with these requests.
6.3.2 Once subscription details are received the traveller will have access to an online question and answer section where queries are answered by the Tripbod in the subscribed country. This is to be used for serious questions which cannot reasonably be answered elsewhere and must not be abused by customers.
6.4 No order submitted by you is accepted by us until we confirm by e-mail or, at our option, in any durable medium which includes e-mail, our acceptance of the contract in question. No contract shall exist between you and us until we confirm our acceptance of your order in this way. Please note that our acknowledgement of receipt of your order is not our acceptance of your order which we will send separately.
6.5 If you decide to submit an order, then our agreement with you shall be for a maximum period of twelve months per country, without re-entry to the country. If you require further services beyond this period another subscription must be purchased.
6.6 We reserve the right to place reasonable restrictions on the extent and nature of any goods or services ordered. These restrictions, if any, will be based on the particular country you propose to visit and will take account of any particular risks that may be associated with the country in question.
6.7 We are not liable for any loss or injury suffered by you as a consequence of your decision to travel to a country where the British Foreign and Commonwealth Office has warned against travel. Our services are not a substitute for your need to consider appropriate travel and medical insurance and obtain all such cover as is prudently necessary. Our local representative cannot provide legal, medical or security assistance although they will, of course, do everything reasonably in their power to assist by putting you in contact with appropriate local services and authorities. Your Safe Planet Ltd advises all travellers to sign up to the Foreign and Commonwealth LOCATE system: http://www.fco.gov.uk/en/travelling-and-living-overseas/Locate/.
6.8 We will not be liable for any service provided by a third party that may be linked in any way to Your Safe Planet Limited, including casualty evacuation organisations and local service providers abroad. Your Safe Planet Limited is a provider of information only.
7. DESCRIPTION
7.1 All product descriptions and content on our website, including those set out further in these terms and conditions or otherwise supplied or issued by us, are intended merely to present a general idea of our services. If you require any further details, please contact us by e-mail, providing details of any additional information needed. However, if you obtain services which are not as described, have an unsuitable specification which was not apparent from our website, or when provided by us do not match our description of them, then we will at our option either supply alternative services, replace (where appropriate) services and/or refund any money paid for services not supplied.
7.2 Our services will consist of pre-departure information provision and trip planning advice. All information is as up-to-date and reliable as possible to the best of our knowledge.
7.2.1 Our services do not consist of in-country meetings or services or support.
7.2.2 The service offered by Tripbod.com extends only to the provision of the information supplied by Tripbod.com and the Tripbod on the ground and does not cover providing a local courier or equivalent services.
7.2.3 If you are travelling as a family or larger group, then although we are delighted to assist you, we do reserve the right for our Tripbod only to provide a similar level of service to that which we provide to individual travellers.
8. PRICE AND AVAILABILITY
8.1 The price and availability of our services is shown on the ‘How It Works’ page of the website. The standard price for each service package depends on the length of your trip, ranging from £10.99 to £150. This price includes all applicable taxes (including VAT).
8.2 If services are unavailable or we need to vary the price to take account of any substantial increase in our suppliers’ prices, changes in taxes and duties, site errors, other errors or omission in the price displayed on our website or in any confirmatory correspondence, we shall notify you by e-mail and allow you an opportunity to cancel your order. If we have already started the services we will allow you to discontinue them and pay us only for work already carried out.
9. PAYMENT
9.1 We accept payment by all major credit and debit cards facilitated by Sage Pay, an online payment solution.
9.2 We will deduct the payment for the chosen services when we accept your contractual offer and commence performance of the services.
9.3 If for any reason we do not receive any payment on the due date then we may delay performance of the services until such time as payment is received by us. This must be a minimum of 9 days pre-departure.
10. DELIVERY
10.1 You must ensure that you fully and accurately complete our questionnaire so as to give us any necessary information to enable us to carry out the services. You warrant to us that the information supplied is correct.
10.2 We will use all reasonable endeavours to perform the services of pre-departure briefing within the above stated time frame.
11. OUR GUARANTEE
11.1 We will supply services which are of a reasonably acceptable standard and free of negligence by us or our Tripbod but we will not be liable for loss unless we or our Tripbod has been guilty of:-
11.1.1 wilful or accidental damage, misuse or neglect by third parties; or
11.1.2 unauthorised alterations or additions by third parties.
We will not be liable for:
11.2.1 any unforeseeable circumstances which are not due to our fault or negligence; or
11.2.2 any attempted action made by you to replace any service otherwise to be supplied by us; or
11.2.3 any failure to follow our instructions and advice.
11.3 Provided that you tell us within a reasonable time after discovery of any defect in our services, we will refund to you the price of the services (or a proportionate part of that price, if appropriate). This obligation to refund the price paid shall constitute a limitation of our liability to you under our contract with you.
11.4 Nothing in this guarantee affects any of your statutory rights as a consumer, details of which are set out in condition 14 below.
12 LIMIT OF LIABILITY
12.1 This website or any part of it may not be compatible with your browser or computer configuration and we make no warranty that it is. We make no warranty that your access to our website will be uninterrupted, timely or error free and we will not be responsible if we are unable to provide the website for whatever reason.
12.2 We will accept all liability if something we do causes death or personal injury. This does not include incidents arising from your use of the information we provide. We will also accept all liability for damage to your property if the cause is our fault.
12.3 Provided you are not purchasing the services for business purposes, we are also responsible for loss caused by:-
12.3.1 the services not matching our description of them;
12.3.2 the services not being of a reasonable quality that you would expect of such services;
12.3.3 our service being negligent.
12.4 Other than the liability we have accepted as described above, we will not be liable for any losses that you suffer as a result of any breach of our agreement, except those losses which are a foreseeable consequence of the breach. In particular, since the services are provided to you as a consumer, we cannot accept responsibility for any losses related to any business of yours such as lost data, lost profits or other business loss that you may incur as a result of any breach of our agreement.
13 YOUR RIGHT OF CANCELLATION
13.1 You have a right to cancel our agreement without penalty and without giving any reason and this right can be exercised by forwarding to us at Your Safe Planet Limited Bridgefield House, Spark Bridge, Ulverson LA12 8DA a notice of cancellation within the time limits set out below. At the end of these terms and conditions is a form of cancellation which you may use, but we will accept any other form of cancellation provided it is addressed to us and adequately identifies you and the services. Please also quote the relevant order reference number (which you can find on our order confirmation).
13.2 You may exercise this right to cancel within seven working days after our agreement with you is made which is when we confirm your order unless we have already started performing the services.
13.3 If you exercise your right of cancellation, this will also cancel any related credit agreement.
14. STATUTORY RIGHTS
14.1 As a consumer you have certain statutory rights regarding statements made in public by us or our representatives and the performance of our services, as well as claims in respect of losses caused by our negligence or our failure to carry out our obligations. In certain circumstances you may require us to reduce the price you have paid for our services or cancel your contract with us. Nothing in these terms and conditions affects those statutory rights.
14.2 You also have certain statutory rights under the Electronic Commerce (EC Directive) Regulations 2002 because we are advertising and selling services online. If we do not comply with these Regulations you have certain remedies. These terms and conditions do not affect your remedies under those Regulations.
14.3 For further information about your statutory rights, please contact your local authority Trading Standards Department or Citizens’ Advice Bureau.

16. COMPLAINTS
16.1 Our website is operated and controlled from the United Kingdom and these terms and conditions and your use of this website are governed by and construed in accordance with the laws of the relevant part of the United Kingdom.

17. DISTANCE SELLING
These terms and conditions are intended to be consistent with the Consumer Protection (Distance Selling) Regulations 2000 as amended, and nothing in them is intended to impose on you any duty or liability additional to those specified in those Regulations. If you would like a copy of these Regulations, they can be obtained from the Department of Business, Innovation and Skills.
18. PRIVACY POLICY
18.1 This website is owned and operated by Your Safe Planet Limited.
18.2 Our privacy policy relates only to information that we obtain from you. If you visit a website operated by a third party through a link included on this website, your information might be used differently by the operator of the linked website.
18.3 The information you provide to us when using this website will be processed for the following reasons:-
18.3.1 to administer your user account with us;
18.3.2 to process any request for advice or information supplied by us;
18.3.3 to notify you of our bulletins, information packs and services should you consent to receiving these from us;
18.3.4 to customise this website according to your interests;
18.3.5 to comply with our statutory and regulatory obligations; and

18.4.5 your interests

18.4.7 details about the services you specifically request.
18.5 We will never collect sensitive information about you without your explicit consent.
18.6 Any information that we collect about you is stored electronically on our database. It may also be printed and stored in our filing system.
18.7 We will keep your personal information confidential except to the extent that we are compelled to disclose it by law (for example where fraud or other crime is involved) or to comply with an instruction from a regulatory body of competent jurisdiction (such as The Information Commissioner). From time to time we may be called upon to demonstrate our maintenance of certain professional standards as set by appropriate authorities and/or to satisfy our auditors and/or to comply with regulations in relation to money laundering or other statutory requirements. If you do not consent to our production of your details for this purpose only as an exception to our duty of confidentiality, you can let us know by checking the appropriate box on the new account registration form.
18.8 If you believe that the information we hold about you is inaccurate or if you wish us to cease processing your data for any particular purpose or purposes then you should write to us at the above address to notify us of this.
18.9 To comply with the Data Protection Act 1998 we adhere to strict security procedures. The personal information which we hold will be held securely to ensure no unauthorised disclosure or access. When you register for a user account with us you will be required to adhere to the security provisions set out in these terms and conditions.
18.10 We reserve the right to appoint an internet service provider to host our website on our behalf which may be situated outside the European Economic Area. By agreeing to the terms and conditions of use of our website you consent to any transfer of your personal information outside the European Economic Area. This may be necessary for us to achieve the purposes set out above. It will be necessary for us to send data to all parts of the world nominated by you as a destination to which you plan to travel as well as third countries where this is necessary in order for us to provide the appropriate services to you. All data received by our local representatives will be delivered to and held by the recipients under an express duty of confidentiality and will be handled in accordance with EU law.
18.11 We would like to contact you in the future for marketing purposes by post, e-mail and telephone but we need your consent before we can do this. If you would like us to contact you (including via e-mail or telephone) concerning our services, offers and career opportunities that may be of interest to you then please check the appropriate box on the new account registration form.
18.13 Should you wish to obtain a copy of the personal data that we hold concerning you, please send an e-mail to the following address:- info@tripbod.com. As soon as we are satisfied as to your identity, we will send to you, within 40 days, a copy of all the data that we hold concerning you.
18.14 If you have a complaint regarding any breach of this privacy policy, contact us at info@tripbod.com. When we receive the complaint, we will review it and ensure that we are in compliance with our privacy policy and all applicable laws. We will contact you within 40 days of receiving your complaint to inform you of the results of your complaint.
18.15 When visiting our web pages, we would like to use tracking technologies which will record and store information about you automatically. This may include using a “cookie” which would be stored on your browser. If we cannot use such technology it is possible that certain functions of this site might be affected and you might not be able to access certain Web pages. We also might not be able to process your order. This information does not identify you personally. We automatically collect and store only the following information about your visit:-
18.15.1 the internet domain and IP address from where you access our website;
18.15.2 the type of browser software and operating system used to access our website;
18.15.3 the date and time you access our website;

18.16 We have appointed Sage Pay to collect credit card payments for the Service from you on our behalf. All credit card transactions conducted from this website are carried out over a secure link for your security. By transmitting your credit card details, you agree to our agent using your details for the purposes of:-
18.16.1 authorising your credit card;
18.16.2 debiting your credit card account for such of our goods that you buy [and/or services you use]; and
18.16.3 advising us that payment has been made.
19. GENERAL
You are not permitted to transfer your rights and obligations under these terms and conditions without our written authority. This authority will not be refused without good reason.
